This Privacy Policy explains how PICK-A-STUDIO LIMITED (“Pickastudio”, “we”, “us”, or “our”) collects, uses, stores, shares and protects personal information when you access or use the Pickastudio website, platform, applications, services, dashboards and related features (collectively, the “Platform”).

Pickastudio is a marketplace that connects people looking for creative spaces and related services with Hosts who list Studios and Add-On Services for booking.

This Privacy Policy should be read together with the Pickastudio Terms and Conditions, Cancellation and Refund Policy, Community/Content Rules and any other policies that refer to or incorporate this Privacy Policy.

By using Pickastudio, you acknowledge that you have read and understood this Privacy Policy.

1. WHO WE ARE

Pickastudio is responsible for determining how and why personal information is processed in connection with the Platform, subject to applicable data protection laws.

For purposes of applicable data protection legislation, Pickastudio may act as a data controller or similar responsible entity in relation to personal information that we collect and process.

Where Pickastudio processes personal information on behalf of another party under that party’s instructions, Pickastudio may act as a data processor or service provider as applicable.

We collect information that you provide directly to us, information generated through your use of the Platform and information received from third parties where permitted by law.

2.1 Account and Registration Information

When you create an Account, we may collect:

  • first and last name;
  • username;
  • email address;
  • telephone number;
  • password or authentication information;
  • profile photograph;
  • business name;
  • business information;
  • account role or preferences;
  • referral or invitation information;
  • location information;
  • communication preferences; and
  • other information necessary to create and manage your Account.

2.2 Host and Studio Information

If you create or manage a Studio listing, we may collect:

  • Studio name;
  • Studio description;
  • Studio photographs and videos;
  • Studio address and location;
  • facilities and amenities;
  • equipment information;
  • Studio rules;
  • availability;
  • pricing;
  • access instructions;
  • permitted activities;
  • Add-On Services;
  • business information;
  • ownership or authority-to-operate information;
  • licences, permits or other documentation where required;
  • Host verification information; and
  • other information necessary to operate and promote the listing.

Some of this information may be publicly displayed on the Platform.

2.3 Identity and Verification Information

To maintain marketplace safety, prevent fraud or provide certain Platform features, Pickastudio may request verification information.

This may include:

  • government-issued identification;
  • business registration information;
  • proof of address;
  • bank-account information;
  • photographs;
  • telephone verification;
  • information confirming ownership or authority to operate a Studio; and
  • other information reasonably required for verification.

Where we collect identity documents or other sensitive verification information, we will process such information only for appropriate and lawful purposes and in accordance with applicable data protection requirements.

2.4 Booking Information

When you make or participate in a Booking, we may collect:

  • Studio selected;
  • Booking date;
  • Booking time;
  • number of people attending;
  • project or intended-use information where provided;
  • Booking Request information;
  • Booking status;
  • cancellation information;
  • Add-On Services selected;
  • messages relating to the Booking;
  • payment status;
  • refund information;
  • Host and Creative information associated with the Booking; and
  • other information necessary to administer the Booking.

2.5 Payment and Financial Information

When you make a payment or request a payout, we may process information such as:

  • payment status;
  • transaction reference;
  • amount paid;
  • currency;
  • payment method;
  • billing information;
  • bank-account information;
  • payout information;
  • refund information;
  • chargeback information; and
  • other information necessary to administer payments and payouts.

Where payments are processed through third-party payment providers, such as Paystack, Flutterwave or another payment provider, those providers may collect and process payment information under their own privacy policies and terms.

Where payment details are processed directly by a third-party payment provider, Pickastudio may not receive or store the full underlying card or payment credentials.

2.6 Communications

When you communicate through Pickastudio, we may collect and retain:

  • messages;
  • enquiries;
  • support requests;
  • reports;
  • complaints;
  • reviews;
  • comments;
  • responses to support communications; and
  • other communications exchanged through the Platform.

We may use this information to provide services, resolve disputes, investigate reports, prevent fraud, enforce our Terms and maintain Platform safety.

2.7 Reviews and User Content

Users may submit content including:

  • photographs;
  • videos;
  • Studio descriptions;
  • reviews;
  • ratings;
  • messages;
  • logos;
  • business information;
  • listing content; and
  • other materials.

Some User Content may be publicly visible on the Platform.

You should not submit personal information belonging to another person unless you have the necessary permission or another lawful basis to do so.

2.8 Location Information

We may collect or process location information provided by you or associated with your use of the Platform.

This may include:

  • Studio addresses;
  • approximate location;
  • location entered into search functions;
  • location information associated with listings; and
  • technical location information where enabled or permitted.

We may use mapping services, including Google Maps or similar services, to display Studio locations and assist with discovery and navigation.

2.9 Technical and Device Information

When you access the Platform, we may automatically collect information such as:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • device identifiers;
  • pages or features accessed;
  • referring pages;
  • dates and times of access;
  • session information;
  • approximate location derived from technical information;
  • crash and diagnostic information; and
  • other technical information concerning your interaction with the Platform.

2.10 Cookies and Similar Technologies

Pickastudio may use cookies, pixels, tags, local storage and similar technologies.

These technologies may be used to:

  • keep you signed in;

  • maintain security;
  • operate essential Platform functions;
  • understand how Users interact with the Platform;
  • measure Platform performance;
  • analyse traffic;
  • improve search and discovery;
  • understand listing performance;
  • prevent fraud and abuse; and
  • support marketing or advertising activities where permitted.

Some cookies may be provided by third-party services.

Where applicable, you may manage non-essential cookies through the cookie controls or settings provided by the Platform.

3. HOW WE USE PERSONAL INFORMATION

Pickastudio may use personal information for the following purposes:

Providing and operating the Platform

We may use information to:

  • create and manage Accounts;
  • provide access to Platform features;
  • allow Hosts to create and manage listings;
  • allow Users to discover Studios;
  • process Booking Requests;
  • facilitate Bookings;
  • facilitate communication between Users;
  • provide dashboards and account features;
  • process payments and payouts;
  • facilitate cancellations and refunds;
  • provide customer support; and
  • otherwise operate the marketplace.

Verification and safety

We may use information to:

  • verify Users and Hosts;
  • verify Studios;
  • prevent fraud;
  • detect suspicious activity;
  • investigate complaints;
  • investigate damage or loss claims;
  • enforce Platform rules;
  • protect Users;
  • protect Pickastudio; and
  • comply with legal obligations.

Platform improvement

We may use information to:

  • understand Platform usage;
  • analyse search behaviour;
  • understand listing performance;
  • improve features;
  • improve the User experience;
  • identify technical problems;
  • develop new services; and
  • improve marketplace performance.

Communications

We may use information to send:

  • Booking confirmations;
  • Booking updates;
  • payment information;
  • payout information;
  • verification messages;
  • security notifications;
  • customer support messages;
  • account notifications;
  • policy updates; and
  • other communications necessary to provide the Platform.

Marketing

Where permitted by applicable law, we may use your information to send marketing communications about:

  • Pickastudio;
  • Studios;
  • services;
  • promotions;
  • events;
  • Platform features; and
  • other relevant opportunities.

You may unsubscribe from marketing communications using the available unsubscribe mechanism.

Unsubscribing from marketing communications does not necessarily stop transactional, security or legally required communications.

4. LEGAL BASES FOR PROCESSING

Where applicable data protection law requires a lawful basis for processing personal information, Pickastudio may rely on one or more lawful bases, depending on the circumstances.

These may include:

Performance of a contract

We may process information where necessary to:

  • create and manage your Account;
  • process a Booking;
  • facilitate payments;
  • facilitate payouts;
  • provide requested services; or
  • perform obligations under our agreement with you.

Consent

We may process information based on your consent where consent is required or appropriate.

Where processing is based on consent, you may withdraw your consent where permitted by law.

Withdrawal of consent does not necessarily affect processing that occurred before withdrawal or processing that can lawfully continue on another basis.

Legal obligations

We may process information where necessary to comply with legal, regulatory, tax, accounting, law-enforcement or other legal obligations.

Legitimate interests

Where permitted by applicable law, we may process information for legitimate interests such as:

  • protecting the Platform;
  • preventing fraud;
  • improving our services;
  • maintaining marketplace safety;
  • enforcing our Terms;
  • responding to disputes;
  • protecting Users;
  • maintaining information security; and
  • operating and developing our business.

Where we rely on legitimate interests, we will consider the applicable legal requirements and the rights and interests of affected individuals.

We may process information where necessary to protect the safety, rights, property or security of Users, Pickastudio or other persons, where permitted by law.

5. WHEN WE SHARE PERSONAL INFORMATION

Pickastudio does not sell personal information to third parties for money.

We may share personal information where reasonably necessary to operate the Platform, provide services, protect Users or comply with legal obligations.

This may include sharing information with the following categories of recipients.

5.1 Hosts and Creatives

Certain information may be shared between Users where necessary to facilitate a Booking.

For example, a Host may receive information necessary to manage a Booking, while a Creative may receive information necessary to attend and use a Studio.

We will not disclose more information than reasonably necessary for the relevant marketplace purpose, subject to applicable law.

5.2 Payment Providers

We may share information with payment providers and financial service providers to process:

  • payments;
  • refunds;
  • payouts;
  • chargebacks;
  • transaction verification; and
  • related financial activity.

5.3 Verification Providers

Where we use third-party identity, business or verification services, we may share information necessary to perform verification and fraud-prevention checks.

5.4 Technology and Service Providers

We may use third-party providers for:

  • hosting;
  • cloud storage;
  • communications;
  • email;
  • SMS;
  • analytics;
  • customer support;
  • fraud prevention;
  • security;
  • identity verification;
  • mapping;
  • payment processing;
  • software infrastructure; and
  • other services necessary to operate Pickastudio.

These providers may process information on our behalf or independently under their own applicable terms, depending on the nature of their service.

5.5 Analytics Providers

Pickastudio may use analytics services such as Google Analytics, Microsoft Clarity or similar tools.

These services may collect information about how Users interact with the Platform, subject to their respective privacy practices and applicable law.

5.6 Legal and Regulatory Authorities

  • comply with a law, regulation, court order or legal process;
  • respond to a lawful request from a government authority;
  • prevent or investigate fraud;
  • prevent crime;
  • protect someone’s safety;

5.7 Corporate Transactions

If Pickastudio is involved in a merger, acquisition, restructuring, financing, sale of assets or similar corporate transaction, personal information may be transferred or disclosed as part of that transaction, subject to applicable law.

6. PUBLIC INFORMATION

Certain information submitted to Pickastudio may be publicly visible.

For example, information associated with a Studio listing may include:

  • Studio name;
  • Studio photographs;
  • Studio description;
  • location or approximate location;
  • facilities;
  • pricing;
  • availability;
  • Host or business name;
  • reviews and ratings; and
  • other listing information.

Hosts should avoid publishing unnecessary personal information in public listing fields.

Users should also consider carefully what personal information they include in reviews, messages, photographs, videos and other publicly visible content.

7. INFORMATION ABOUT OTHER PEOPLE

You must not provide Pickastudio with another person’s personal information unless you have a lawful basis or appropriate permission to provide it.

For example, if you upload a photograph containing another identifiable person, you are responsible for ensuring that you have the necessary rights and permissions where required.

If you provide information about another person in connection with a Booking, listing, business or service, you should ensure that you are authorised to provide that information.

8. DATA RETENTION

Pickastudio will retain personal information for as long as reasonably necessary for the purposes for which it was collected and processed.

Retention periods may depend on:

  • the nature of the information;
  • the purpose for which it was collected;
  • whether you maintain an Account;
  • whether there is an active or completed Booking;
  • legal and regulatory requirements;
  • tax and accounting requirements;
  • dispute resolution;
  • fraud prevention;
  • security;
  • enforcement of agreements; and
  • the establishment, exercise or defence of legal claims.

When personal information is no longer required, Pickastudio may delete, anonymise or securely dispose of it, subject to applicable law and legitimate retention requirements.

9. DATA SECURITY

Pickastudio takes reasonable technical and organisational measures designed to protect personal information against:

  • unauthorised access;
  • accidental loss;
  • misuse;
  • alteration;
  • disclosure;
  • destruction; and
  • other unauthorised processing.

Security measures may include access controls, authentication procedures, technical safeguards, monitoring and other appropriate measures.

However, no internet-based platform or electronic transmission can be guaranteed to be completely secure.

You are responsible for keeping your Account credentials confidential and should immediately notify Pickastudio if you believe your Account has been compromised.

10. DATA BREACHES

Where Pickastudio becomes aware of a personal data breach, we may investigate the incident and take appropriate remedial measures.

Where notification to a regulatory authority or affected individuals is required by applicable law, Pickastudio will make the required notification within the applicable legal timeframe.

11. YOUR DATA PROTECTION RIGHTS

Depending on applicable law, you may have rights concerning your personal information.

These may include the right to:

  • request access to personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • request deletion or erasure of personal information in appropriate circumstances;

We may request additional information where reasonably necessary to verify that the person making the request is the relevant data subject or is authorised to act on their behalf.

We will respond to valid requests within the period required by applicable law.

13. CHILDREN AND MINORS

Pickastudio is intended for persons who are legally capable of entering into binding agreements.

We do not knowingly collect personal information from children where doing so is prohibited by applicable law.

We may take reasonable steps to investigate and delete such information where appropriate.

14. INTERNATIONAL DATA TRANSFERS

Pickastudio is a Nigerian company, but we may use service providers, technology providers, payment providers, hosting providers and other third parties located in Nigeria or other countries.

As a result, personal information may be processed or transferred outside Nigeria.

Where personal information is transferred outside Nigeria, Pickastudio will take reasonable steps to ensure that the transfer is carried out in accordance with applicable data protection requirements.

This may include relying on an adequacy decision, appropriate contractual or other recognised safeguards, or another lawful basis permitted under applicable law.

The Nigeria Data Protection Act 2023 contains specific requirements concerning transfers of personal data outside Nigeria.

Where required by applicable law, Pickastudio will maintain appropriate records and safeguards concerning international data transfers.

15. THIRD-PARTY SERVICES

Pickastudio may integrate with or rely on third-party services, including:

  • Paystack;
  • Flutterwave;
  • Google Maps;
  • Google Analytics;
  • Microsoft Clarity;
  • hosting providers;
  • communications providers;
  • identity verification providers;
  • payment service providers;
  • calendar synchronisation services;
  • security providers; and
  • other technology or service providers.

Third-party services may collect and process information under their own privacy policies and terms.

Pickastudio does not control the privacy practices of third parties and Users should review the relevant third-party privacy notices where appropriate.

16. GOOGLE MAPS AND LOCATION SERVICES

Pickastudio may use Google Maps and related services to display Studio locations, assist with location-based search and provide mapping functionality.

Use of Google Maps and related services may involve the processing of location or technical information in accordance with the applicable Google privacy and service terms.


17. ANALYTICS

Pickastudio may use analytics services to understand:

  • Platform traffic;
  • User behaviour;
  • listing performance;
  • search and engagement patterns;
  • technical performance; and
  • general marketplace trends.

Analytics may involve the collection of technical, usage and interaction information.

We may use analytics information to improve the Platform, understand marketplace activity and develop new features.

Where applicable, analytics cookies or similar technologies may be managed through our cookie controls.

18. MARKETING COMMUNICATIONS

Pickastudio may send transactional communications relating to:

  • Bookings;
  • payments;
  • account activity;
  • security;
  • verification;
  • support;
  • policy updates; and
  • other necessary Platform matters.

Where permitted by law, we may also send promotional communications.

You may unsubscribe from marketing communications through the unsubscribe mechanism included in the relevant communication or through other available Platform settings.

Unsubscribing from marketing communications will not necessarily stop transactional or legally required communications.

19. COOKIES

Pickastudio may use cookies and similar technologies to operate and improve the Platform.

Cookies may be:

  • strictly necessary;
  • functional;
  • analytical;
  • performance-related; or
  • used for marketing or other purposes where permitted.

Where required by applicable law, Pickastudio will obtain consent before placing or using non-essential cookies or similar technologies.

You may be able to control cookies through your browser settings or Pickastudio’s cookie-management tools.

Disabling certain cookies may affect the functionality of parts of the Platform.

20. AUTOMATED DECISION-MAKING

  • ranking or search;

  • Platform optimisation.

Where applicable law provides rights concerning solely automated decision-making that produces legal or similarly significant effects, Pickastudio will comply with those requirements.

21. USER-GENERATED CONTENT AND PRIVACY

Users retain ownership of User Content that they own, subject to the licence granted to Pickastudio under the Terms.

By submitting User Content to Pickastudio, you may grant Pickastudio rights to host, store, reproduce, format, display, distribute and use the content as reasonably necessary to operate, promote, improve and provide the Platform.

You should not submit confidential, highly sensitive or unnecessary personal information in public listing fields, reviews or other User Content.

22. ACCOUNT DELETION

You may request deletion of your Pickastudio Account by contacting:

Account deletion may not result in the immediate deletion of every piece of information associated with the Account.

Pickastudio may retain information where necessary to:

  • comply with legal obligations;
  • maintain financial or transaction records;
  • prevent fraud;
  • resolve disputes;
  • enforce our Terms;
  • protect the Platform;
  • establish, exercise or defend legal claims; or
  • comply with other legitimate retention requirements.

Where appropriate, information that is no longer needed may be deleted or anonymised.

23. YOUR RESPONSIBILITIES

You are responsible for ensuring that information you provide to Pickastudio is accurate and current.

You should:

  • keep your Account information updated;
  • protect your login credentials;
  • avoid sharing your password;
  • notify us of unauthorised Account access;
  • avoid submitting unnecessary personal information;
  • obtain appropriate permission before submitting another person’s information; and
  • use the Platform in accordance with the Terms.

24. PRIVACY OF PAYMENTS

Pickastudio may use third-party payment providers to process payments.

Pickastudio does not necessarily receive or store complete payment-card information where the payment process is handled directly by a third-party payment provider.

Payment providers may collect and process financial information according to their own privacy policies, terms and legal obligations.

25. BUSINESS AND HOST INFORMATION

Where a Host operates a Studio as a business, Pickastudio may process business-related information including:

  • business name;
  • business registration information;
  • business address;
  • contact information;
  • ownership or authority information;
  • payout information;
  • tax information;
  • Studio information; and
  • verification documentation.

Some business and Studio information may be publicly displayed as part of a listing.

26. LEGAL AND REGULATORY COMPLIANCE

Pickastudio may process personal information where reasonably necessary to comply with:

  • applicable laws;
  • regulations;
  • court orders;
  • lawful government requests;
  • tax obligations;
  • accounting requirements;
  • financial and payment obligations;
  • fraud-prevention requirements;
  • regulatory requirements; and
  • legal proceedings.

We may also retain and disclose information where reasonably necessary to establish, exercise or defend legal claims.

27. PRIVACY OF COMMUNICATIONS

Pickastudio may review or process communications made through the Platform where permitted by law and reasonably necessary to:

  • provide customer support;
  • investigate reports;
  • prevent fraud;
  • protect Users;
  • enforce the Terms;
  • investigate suspected abuse;
  • maintain Platform security; or
  • comply with legal obligations.

Pickastudio does not guarantee that communications made through the Platform are completely private or confidential.

Users should not use Platform messaging to exchange information that they are not authorised to disclose.

28. CHANGES TO THIS PRIVACY POLICY

Pickastudio may update this Privacy Policy from time to time to reflect:

  • changes to the Platform;
  • changes to our services;
  • changes to technology;
  • changes to third-party providers;
  • changes to data protection requirements; or

Where applicable, you may have the right to lodge a complaint with the relevant data protection authority concerning Pickastudio’s processing of your personal information.

The Nigeria Data Protection Act 2023 provides data subjects with rights and protections concerning the processing of their personal data.
